These Terms and Conditions ("Terms") govern your access to and use of CashCowLeads.com, including our website, dashboard, lead delivery system, and related services (collectively, the "Service"). The Service is operated by Trend Watchers, LLC ("Company," "we," "us," or "our"). By creating an account, adding funds, or using the Service in any way, you ("you," "your," or "Customer") agree to be bound by these Terms. If you do not agree, you must not access or use the Service.

These Terms incorporate by reference our Privacy Policy and Refund Policy and, if applicable, our Affiliate Program Terms of Service.

1. Eligibility and Accounts

1.1 Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, to use the Service. By using the Service, you represent that you meet this requirement and that you have the authority to enter into these Terms on behalf of yourself or the business you represent. The Service is intended for use by local service professionals and businesses, and you represent that you are using the Service for legitimate business purposes.

1.2 Account Registration

To use the Service, you must create an account and provide accurate, current, and complete information, including your name, business name, service type, geographic area, email address, and phone number. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, whether or not authorized by you. You must notify us immediately of any unauthorized use of your account.

2. The Service

2.1 Description

CashCowLeads monitors publicly visible posts in Facebook Groups and similar public online communities where individuals have expressed a need for local services ("Leads"). When the Service identifies a post that matches your configured service type and geographic area, it forwards that Lead to you via text message and email notification, and a per-lead charge is deducted from your account balance.

2.2 Nature of Leads

Leads consist of publicly available information posted by individuals in public online forums. We do not collect, store, or transmit private messages, private profile data, or any non-public information from Facebook or any other platform. We are not affiliated with, endorsed by, or in any way partnered with Facebook or Meta Platforms, Inc. Your use of Lead information is subject to these Terms, our Privacy Policy, and all applicable laws.

2.3 No Guarantee of Lead Volume or Quality

The availability of Leads depends on real-time public activity in the communities we monitor and is outside our control. We do not guarantee any minimum number of Leads per day, week, or month, nor do we guarantee that any Lead will result in a booked job, a response, revenue, or any other business outcome. Lead volume will vary based on your service area, service type, time of year, and online community activity in your region.

2.4 Lead Delivery

Leads are delivered to you via text message and email to the contact information associated with your account. You are responsible for ensuring your contact information is accurate and up to date. We are not responsible for undelivered notifications due to inaccurate contact information, carrier issues, spam filtering, or any other factor outside our control. A Lead is considered delivered once it has been sent to the phone number or email address on file for your account.

3. Account Balance and Per-Lead Billing

3.1 Prepaid Balance

The Service operates on a prepaid basis. To receive Leads, you must maintain a positive account balance. You add funds to your account in advance, and a per-lead fee is automatically deducted from your balance each time a Lead is delivered to you. The per-lead fee applicable to your account will be displayed in your account dashboard and may vary based on your plan or service type.

3.2 Low Balance

If your account balance falls to zero, Lead delivery will pause until your balance is replenished. We are not responsible for any Leads missed during a period when your balance is insufficient. You may enable automatic top-up in your account settings to avoid interruptions.

3.3 No Refunds

All funds added to your account balance are final and non-refundable, including any unspent balance remaining at the time of account cancellation, closure, or termination, for any reason. Please review our Refund Policy in full before adding funds to your account.

3.4 Price Changes

We reserve the right to change per-lead fees at any time. We will provide reasonable advance notice of any fee change. Continued use of the Service after a fee change takes effect constitutes your acceptance of the new rate.

4. Acceptable Use of Leads

You agree to use Leads delivered through the Service solely to respond to the expressed local service need in a professional, honest, and lawful manner. You agree not to:

6.1 Our Property

The Service, including its software, design, lead matching algorithms, workflows, branding, and all related intellectual property, is owned by Trend Watchers, LLC or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.

6.2 Lead Information

Lead information forwarded to you through the Service is drawn from publicly available sources and is provided to you for the sole purpose of following up on the service request identified. We do not claim ownership of Lead information, but we retain all rights in the systems, processes, and methods used to identify and deliver it.

7. Text Message Communications

By providing your phone number and using the Service, you consent to receive recurring automated text messages from CashCowLeads containing lead notifications and account-related communications. Message frequency varies based on lead activity in your area. Message and data rates may apply. You may opt out of text notifications at any time by updating your preferences in your account settings or by replying STOP to any text message from us. Opting out of text notifications will pause lead delivery via SMS but will not cancel your account or affect your balance.

8. Third-Party Platforms

The Service monitors publicly visible content on third-party platforms including Facebook. We are not affiliated with, endorsed by, sponsored by, or in any way officially connected to Facebook or Meta Platforms, Inc. Changes to Facebook's platform, policies, or public content availability may affect the volume or availability of Leads, and we will not be liable for any such impact. Your use of Facebook and any other third-party platform remains subject to that platform's own terms of service and privacy policies.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT LEADS WILL BE AVAILABLE IN YOUR AREA, THAT ANY PARTICULAR VOLUME OF LEADS WILL BE DELIVERED, OR THAT ANY LEAD WILL RESULT IN A BOOKED JOB, REVENUE, OR ANY OTHER BUSINESS OUTCOME. ANY RESULTS OR EXAMPLES REFERENCED IN OUR MARKETING MATERIALS ARE ILLUSTRATIVE ONLY AND ARE NOT GUARANTEES OF YOUR RESULTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TREND WATCHERS, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES ARISING FROM LOW LEAD VOLUME, LEAD QUALITY, UNDELIVERED NOTIFICATIONS, OR THE OUTCOME OF ANY CONTACT YOU MAKE WITH AN INDIVIDUAL THROUGH A LEAD. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL FUNDS ADDED TO YOUR ACCOUNT IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Trend Watchers, LLC and its officers, directors, employees, agents, and affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your use of or follow-up on any Lead; (c) any communication you initiate with an individual based on a Lead; (d) your violation of these Terms or any applicable law; or (e) any third-party claim arising from your business activities conducted through or in connection with the Service.

12. Term, Suspension, and Termination

12.1 Term

These Terms remain in effect for as long as you maintain an account or use the Service.

12.2 Suspension and Termination by Us

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms, fraudulent activity, abusive conduct toward individuals contacted through Leads, or conduct that we determine, in our sole discretion, poses a risk to the Service, other users, or the public. Termination does not entitle you to a refund of any account balance.

12.3 Termination by You

You may close your account at any time through your account settings or by contacting us in writing. Closing your account does not entitle you to a refund of any remaining balance, as described in our Refund Policy.

12.4 Effect of Termination

Upon termination, your right to access and use the Service ends immediately, Lead delivery ceases, and your account balance is forfeited in accordance with our Refund Policy. Sections of these Terms that by their nature should survive termination, including acceptable use obligations, intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution, will survive.

13. Changes to the Service and These Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also revise these Terms from time to time by posting the updated Terms on this page with a new effective date. For material changes, we will provide reasonable notice such as by email or text message. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the changes, your sole remedy is to stop using the Service and close your account.

14. Relationship of the Parties

You and Trend Watchers, LLC are independent parties. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and the Company. You are solely responsible for your business operations, your conduct toward individuals contacted through Leads, and compliance with all laws applicable to your business and your use of the Service.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any dispute arising under or relating to these Terms shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules, with arbitration taking place in Georgia, United States. Each party shall bear its own costs and attorneys' fees unless the arbitrator determines otherwise. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

16. General Provisions

16.1 Entire Agreement

These Terms, together with the Privacy Policy, Refund Policy, and any other policies referenced herein, constitute the entire agreement between you and Trend Watchers, LLC regarding the Service and supersede all prior or contemporaneous agreements, understandings, and communications, whether written or oral.

16.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, reorganization, or sale of assets.

16.5 Force Majeure

Neither party shall be liable for any delay or failure to perform its obligations under these Terms due to causes beyond its reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, internet or utility failures, changes to third-party platforms, or governmental actions.

16.6 Notices

Notices to the Company shall be sent in writing to the email address below. Notices to you shall be sent to the email address or phone number associated with your account.

16.7 Electronic Agreement

You agree that your electronic acceptance of these Terms (including by checking a box, clicking "I agree," or continuing to use the Service) has the same legal effect as a physical signature and that these Terms may be formed by electronic means.

BY CREATING AN ACCOUNT OR USING CASHCOWLEADS.COM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, INCLUDING THE NO-REFUND POLICY FOR ALL ACCOUNT BALANCES.
